These Terms of Service ("Terms") govern your access to and use of EMS Brain ("Service"), operated by Noah Howard ("we," "us," or "our"), a sole proprietor based in Texas. By creating an account or using the Service, you agree to these Terms.

1. The Service

EMS Brain is an educational study platform for EMS students and working medics preparing for the NREMT exam. It includes quiz drills, flashcards, branching clinical scenarios, an AI-powered study tutor, and progress tracking. The Service is not a substitute for accredited EMS training, formal instruction, or medical advice.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@emsbrain.com if you believe your account has been compromised.

3. Subscriptions and Payment

EMS Brain offers a free tier with limited access and a paid Pro subscription available on monthly ($12.00/month) or annual ($89.99/year) billing cycles. Payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time through the Settings page or by contacting us. Cancellation takes effect at the end of your current billing period โ€” you retain Pro access until then. We do not offer prorated refunds for partial billing periods except where required by law.

4. Refund Policy

If you are not satisfied with your purchase, contact us within 7 days of your initial payment at support@emsbrain.com and we will issue a full refund at our discretion. Refund requests made after 7 days will be evaluated on a case-by-case basis.

6. Intellectual Property

All content on EMS Brain โ€” including quiz questions, scenarios, flashcards, and software โ€” is owned by Noah Howard and protected by applicable copyright laws. You may use the content solely for your personal, non-commercial study purposes.

7. Educational Disclaimer

EMS Brain is designed to supplement โ€” not replace โ€” accredited EMS education and training. Content on this platform, including AI Tutor responses, may not reflect the most current local protocols. Always defer to your medical director, local protocols, and accredited instructors for clinical decision-making.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that it will help you pass the NREMT exam.

9. Limitation of Liability

To the fullest extent permitted by Texas law, Noah Howard shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Texas.

11. Changes to These Terms

We may update these Terms from time to time. We'll notify you of material changes by email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
